This Short-Term Vacation Rental Agreement (“Agreement”) is entered into by and between Sea Maine Vacation Rentals (“Agent” or “Sea Maine”), acting as agent for the Property Owner (“Owner”), and the undersigned Guest (“Guest”). This Agreement governs Guest’s rental and use of the vacation property identified below (the “Property”).

Guest acknowledges the stated maximum occupancy for the Property. Occupancy in excess of the listed maximum is subject to an additional fee of $25 per person, per night, and may constitute a violation of this Agreement if deemed excessive or disruptive.
- RENTAL TERM & PURPOSE
The Property is rented solely for short-term residential vacation use. Commercial use, events, parties, or gatherings are strictly prohibited unless expressly approved in writing by Sea Maine.
- PAYMENT TERMS
- Rental Rate: As outlined in the confirmed reservation
- Taxes & Fees: Applicable state and local lodging taxes, cleaning fees, administrative fees, processing fees, and any approved add-ons
Payment Schedule:
- 50% of the reservation total is due at the time of booking
- The remaining 50% is due 60 days prior to check-in
Failure to remit payment in accordance with this schedule may result in cancellation of the reservation without refund.
- CANCELLATION & PAYMENT POLICY
Payment Structure:
- 50% of the reservation total is due at the time of booking.
- The remaining 50% is due 60 days prior to check-in.
This payment structure is aligned with the cancellation policy below and is designed to minimize refunds.
Cancellation Policy:
- If canceled more than 60 days prior to check-in, Guest will receive a refund of amounts paid in excess of 50% of the reservation total, less any credit card processing fees incurred.
- All payments are non-refundable 60 days or less prior to check-in.
- If ownership of the Property changes and the new owner does not continue short-term rentals, all monies paid will be refunded in full.
Guest acknowledges that, because the initial payment equals 50% of the reservation total, refunds are generally limited to any amounts paid beyond that threshold when cancellation occurs more than 60 days prior to arrival.
- DAMAGE DEPOSIT OR DAMAGE WAIVER
All reservations are subject to a mandatory, non-refundable Damage Waiver, which is automatically included in the total rental fees at the time of booking.
The Damage Waiver provides coverage for accidental damage to the Property and its contents, up to the designated coverage amount for the specific Property, as follows:
- $25 Damage Waiver – covers accidental damage up to $300
- $50 Damage Waiver – covers accidental damage up to $500
- $100 Damage Waiver – covers accidental damage up to $1,000
The applicable coverage level is determined by the Property and is disclosed prior to booking.
The Damage Waiver does not cover intentional damage, missing items, excessive cleaning, violations of house rules, unauthorized pets, smoking, fires, or damage caused by negligence or misuse. Any damage, loss, or costs exceeding the coverage amount, or not covered by the waiver, remain the responsibility of the Guest and may be charged to the payment method on file.
No security deposit or credit card hold is required under this Agreement.

Late check-out or early arrival without approval may result in additional fees.
- HOUSE RULES & GUEST RESPONSIBILITIES
Guest agrees to:
- Maintain the Property in a clean and orderly condition
- Follow all posted house rules and local ordinances
- Respect neighbors, noise ordinances, and quiet hours
- Properly secure the Property when not present
- Dispose of trash according to provided instructions
Violation of house rules may result in fines, immediate eviction, or forfeiture of rental payments.
- NOISE, PARTIES & EVENTS
The Property is intended for quiet enjoyment. Parties, weddings, receptions, or large gatherings are strictly prohibited unless explicitly authorized in writing.
Quiet Hours: 9:00 PM to 9:00 AM for all Sea Maine properties.
Violation of quiet hours, excessive noise, or neighbor complaints may result in fines, immediate eviction, or forfeiture of rental payments without refund.
- PET POLICY
Pet policies vary by Property. Guest must refer to the specific listing or contact Sea Maine Vacation Rentals for written confirmation of whether a Property is pet-friendly prior to arrival.
Non–Pet-Friendly Properties
For Properties that do not permit pets, no animals are allowed, except for legally recognized ADA service animals. Unauthorized animals are grounds for immediate termination of the reservation, forfeiture of rental payments, and additional cleaning or remediation fees.
Pet-Friendly Properties
For approved pet-friendly Properties:
- A non-refundable pet rent of $200 applies for up to two (2) pets, with prior written approval.
- Some breed restrictions apply due to insurance regulations. Prohibited dog breeds include: Pitbull, German Shepherd, Rottweiler, Doberman Pinscher, Bulldog, Chow, and Great Dane.
- Cats and other animals require special written approval.
Unauthorized pets may result in a minimum penalty fee of $500, additional cleaning or damage charges, and possible eviction.
- FIRE & OPEN FLAME POLICY
Open flames or fires are not permitted without prior written approval from Sea Maine Vacation Rentals. This includes, but is not limited to, fireplaces, wood stoves, outdoor fire pits, campfires, bonfires, candles, and any other open-flame devices.
Some Properties may permit limited fire use, while others are restricted due to homeowner insurance requirements or lack of alternative heat sources. Guests must receive written confirmation prior to use. Guests may text Sea Maine to confirm whether fire use is permitted at a specific Property.
Unauthorized use of fires or open flames may result in immediate termination of the reservation, forfeiture of rental payments, and liability for any resulting damages.
- SMOKING POLICY
Smoking or vaping of any kind is strictly prohibited inside the Property. Evidence of smoking will result in additional cleaning and remediation fees.
- MAINTENANCE & ACCESS
Sea Maine Vacation Rentals and its authorized agents reserve the right to access the Property for maintenance, inspections, guest services, or emergencies, with reasonable notice when practicable and as permitted by law.
Guest agrees to promptly report any maintenance or safety issues and to cooperate with access required to remedy such issues.
- WEATHER, ACTS OF GOD & FORCE MAJEURE
No refunds, credits, or date changes will be issued for weather conditions, natural disasters, power outages, utility interruptions, travel delays, transportation issues, or other events beyond Sea Maine’s control (collectively, “Force Majeure Events”), unless otherwise required by law or expressly provided for in the Cancellation Policy.
Guest acknowledges that Maine weather can be unpredictable and accepts the inherent risks associated with travel and coastal conditions. Sea Maine strongly recommends the purchase of travel insurance, available here: https://seamainevacationrentals.rentalguardian.com/
- LIABILITY, ASSUMPTION OF RISK & WATERFRONT USE
Guest acknowledges and agrees that use of the Property and any amenities is at Guest’s own risk. This includes, but is not limited to, waterfront access, docks, shorelines, boats, kayaks, fireplaces (if permitted), grills, stairs, decks, and outdoor areas.
Guest assumes full responsibility for the conduct and safety of all occupants and visitors, including children. Sea Maine Vacation Rentals, the Property Owner, and their agents shall not be liable for any injury, loss, damage, or death occurring on or about the Property, except as required by law.
Dock & Water Access Waivers: Certain Properties may require Guests to execute a separate, property-specific waiver or acknowledgment prior to using docks, waterfront access, kayaks, floats, or related amenities. Guest agrees that use of any dock or water access is strictly prohibited unless all required waivers have been completed and approved by Sea Maine Vacation Rentals. Failure to comply may result in loss of access to the amenity and/or termination of the reservation.
- TERMINATION & EVICTION
Sea Maine reserves the right to terminate this Agreement and evict Guest without refund for:
- Violation of occupancy limits
- Unauthorized parties or events
- Disturbance of neighbors
- Illegal activity
- Violation of any material term of this Agreement
- ABANDONED PERSONAL PROPERTY (MAINE LAW)
If Guest leaves personal property behind after vacating the Property, Sea Maine Vacation Rentals shall provide notice to Guest as required under Maine law.
If the property is not claimed within 7 days after notice is provided, or if Guest fails to retrieve the property within 14 days of such notice, Sea Maine and/or the Property Owner may sell or dispose of the items as permitted by Maine law.
Any proceeds from the sale of abandoned property may be applied to unpaid rent, damages, and reasonable storage or handling costs. Any remaining balance shall be remitted to the Maine State Treasurer, as required by law.
Sea Maine is not responsible for loss or damage to abandoned items.
- GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Maine.
- ENTIRE AGREEMENT
This Agreement, together with the reservation confirmation and house rules, constitutes the entire agreement between the parties. No oral agreements shall be binding.
