Terms & Conditions

This Short-Term Rental Agreement is made by and between Sea Maine Vacation  Rentals LLC and said person making the reservation on  HomeAway, Airbnb, Trip Advisor or similar site as of the date of confirmation sent  from HomeAway, Airbnb, Trip Advisor or similar site. For good and valuable consideration, the  sufficiency of which is acknowledged, the parties hereby agree as follows:  

Leased Premises: The Property Manager does hereby lease, remis, and let the property on a  short-term basis.

Term of Agreement: According to the confirmed reservation sent by email to the Guest from HomeAway, Airbnb, Trip  Advisor or/and the Property Manager. Check-in is at 4 p.m. on the date of arrival confirmed and  Check-out is required by 10 a.m. on the date of departure. 

Rental Charges: The Guest agrees to pay the rent, security deposit and additional taxes and fees  as outlined in the confirmation from the rental booking site HomeAway, Airbnb, or Trip Advisor  as applicable. 

Security Deposit: A security deposit in the amount quoted by the rental booking site will be  collected. The security deposit will be refunded within terms of the booking site subject to  inspection of the property after rental. Guest is responsible for the cost of all damage to the  Premises in excess of the security deposit amount. Charges may be made for the following:  

  • Damage to the Premises (outside of normal wear and tear) 
  • Extensive cleaning (above average) 
  • Unpaid charges 
  • Unreturned linens 
  • Excessive occupancy 
  • Postage for returning items left behind. 
  • Unbagged garbage. 
  • Extra cleaning due to smoking within the house or if a pet is allowed. 
  • Any other costs incurred by homeowner due to Guest’s stay. 

If the property appears damaged upon Check-in, Guest shall inform Property Manager  immediately to ensure deductions are not made against Guest’s deposit.  

Cancellation Policy: If Guest wishes to cancel his/her reservation any amounts paid by  Guest will be refunded (less any credit card fees incurred) according to the following  schedule:  

  • 50% of the reservation total if canceled more than 60 days prior to the original Check-in Date. 
  • All reservations and fees are non-refundable 60 days or less prior to your check-in  date. 

Should ownership of the property change hands, and the new owner does not continue to rent the house, all monies paid will be returned in full.  

Maximum Occupancy: The maximum number of Guests allowed in Premises is 6. If this  number is exceeded without prior approval from the Property Manager, Guest will forfeit the  security deposit and the Property Manager may cancel the agreement without further notice. No  subletting is allowed to others.  

Linens: Sheets, towels, pillows, and blankets are provided with this rental. 

Smoking: Strictly prohibited inside or on the grounds of this property.  

Pets: No pets are allowed without prior approval from the Property Manager. Upon approval, all  pets are subject to a non-refundable pet rent of $200 for up to 2 pets.  

Noise: The Guest shall not cause, nor allow to be caused, excessive noise in or around the  property nor interfere with the rights and quiet and peaceful enjoyment of persons owning or  occupying properties in the surrounding area. No parties are allowed on the Premises. No loud  noises are permitted outdoors between 10:00 PM and 7:00 AM.  

House Rules: Guest agrees to abide by any and all house rules, whether promulgated before or  after the execution of this Agreement, including but not limited to, rules with respect to noise,  smoking, odors, disposal of refuse, parking, putting nails in walls, hanging blinds, racks, or  shelving, removal of or moving furniture.  

Access: Guest shall allow Property Manager access to the property for purposes of repair and  inspection. Property Manager shall exercise this right of access in a reasonable manner.  

Utilities: Utilities are included with the rental (electricity, heat, cable, internet). Utilities charged  in excess will be investigated and are the responsibility of the guest if it is found to be the result  of negligence on the guest’s part.  

Ordinances & Statutes: The Guest shall comply with all the statutes, ordinances, and  requirements of all municipal, state, and federal authorities now in force, or which may hereafter  be in force, pertaining to the use of the Premises.  

Reasonable Efforts of Property Manager: Property Manager shall not be liable for any failure  or delay in performing duties imposed upon them in this Agreement as long as reasonable efforts  are made under the prevailing circumstances to perform these duties.  

Successors & Assigns: This Agreement shall be binding upon and insure to the benefit of the  respective heirs, successors, and assigns of the Property Manager and the Guest.  

Indemnification: The Guest agrees to indemnify and hold harmless the owner and the Property  Manager and its representatives from any and all liability for any loss or damage whatsoever  including but not limited to any claim, action, cause of action or other demand for personal  injury or damage or loss of property which is made, incurred or sustained by the Guest or any  invitee of Guest arising out of, related to or in connection with the rental of the Premises unless the loss or damage is solely the proximate result of gross negligence of the owner or Property  Manager.  

Condition of Premises: The Premises shall be delivered to the Guest at the commencement of  the Term in clean condition with all systems and appliances in good working order. Guest shall  return the Premises to the Property Manager at the end of the Term, and the Premises shall be in  the same condition, reasonable wear and tear, damage by fire and other casualties only excepted.  

Supplies: An initial supply of toilet paper, paper towels, trash bags and cleaning items will be  supplied.  

Trash: If Guest’s needs exceed a weekly trash pickup, please contact Property Manager.  

Arrival and Departure: Check-in time is 4:00 pm or later. Check-out time is 10:00 am.  Property Manager will meet you upon arrival and give Guest a house tour and keys. Keys are to  be left inside the house upon check-out. There is a fee of 50% of one night’s rent for late check out unless prior arrangements have been made.  

Departure and Cleaning: Please leave the house as you found it. Dirty linens should be placed  in a pile in one bathroom or laundry room. Dishes should be cleaned or placed in dishwasher  and run. Please take all food out of the refrigerator and put bagged trash in bins provided. The  house will be thoroughly cleaned before and after your stay. Housekeeping duties during the  rental are the responsibility of the Guest.

The terms of this Agreement are in addition to any terms and conditions specified by the rental  booking site Homeaway, Airbnb, or Trip Advisor. If there is a conflict between their terms and  the terms of this Agreement, this Agreement’s terms shall take precedent. The parties agree to the  terms of this Short Term Rental Agreement, as evidenced by the confirmed booking through  HomeAway, Airbnb, Trip Advisor or similar site as appropriate.
